Il mio amico Enrico Ottogalli mi ha contattata perché chi ha a cuore la giustizia italiana, come lui, in questi giorni è in subbuglio. Il decreto milleproroghe rischia di far saltare una riforma che sarebbe stata il vero processo breve. Ecco quello che ci scrive:

Doveva essere una svolta epocale per il sistema-giustizia italiano . Poteva esserlo. Ma qualcuno (gli avvocati su tutti) ha pensato bene di cercare di bloccare la riforma. E così la mediaconciliazione , novità giuridica introdotta dal d. lgs. n. 28/2010, anziché entrare in vigore nel marzo 2011 (così proclamava il ministro Alfano), rischia di slittare di dodici mesi.
Cos’è - Questo istituto, largamente diffuso all’estero (es. USA, UK, Argentina, Germania, etc.) e fortemente voluto anche a livello comunitario, è uno strumento alternativo per la risoluzione delle liti. Serve, inoltre, a sgravare i tribunali delle tante cause di cui sono oberati. Per certi tipi di controversie, in pratica, prima di rivolgersi alla giustizia ordinaria, bisogna rivolgersi al mediaconciliatore: vale a dire un soggetto imparziale che aiuta effettivamente le parti coinvolte a risolvere la loro lite. Il procedimento conciliativo può avere una durata massima di quattro mesi, terminati i quali o si raggiunge un accordo oppure, in caso contrario, one turns to the judge. Si determinerebbe, in tal caso, un paradosso: verrebbe penalizzato chi si è mobilitato con diligenza e sollecitudine per adempiere ad una norma e favoriti coloro i quali hanno snobbato o, peggio, volutamente sabotato la riforma. Ma se ci dovesse essere questo rinvio di un anno: che fare con le strutture pronte a partire? Freeze for so long as people, vehicles and locations? Now, who reimburse all these people?
